Terms of Use

These Terms of Service ("Terms") govern your access to and use of the Scrub Battle mobile application and all related sub-applications, including but not limited to "Scrub Battle: Clinical Knowledge" (collectively, the "App"), operated by Scrub Battle LLC, a California limited liability company ("Scrub Battle," "we," "us," or "our").

By creating an account, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (available in the App and at www.scrubbattle.com). If you do not agree to these Terms, do not access or use the App.

1. Eligibility and Account Registration

1.1 Minimum Age.

You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction, if higher) to use the App. If you are under the age of majority where you live, you may use the App only with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

1.2 Account Information.

To create an account, you must provide certain information, which may include:

  • Email address
  • Password
  • Medical school
  • Expected graduation year
  • Username
  • Optional profile picture

You agree to provide accurate, current, and complete information and to keep this information updated.

1.3 Account Security.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

  • Immediately notify us at info@scrubbattle.com of any unauthorized use of your account or any other breach of security; and
  • Log out of your account at the end of each session when using a shared device.

We are not liable for any loss or damage arising from your failure to safeguard your account credentials.

2. Educational Purpose; No Medical Advice

2.1 Educational and Entertainment Use Only.

The App provides medical education and exam preparation content (such as questions, explanations, and rankings) intended solely for educational and informational purposes for medical students and related learners.

2.2 No Medical or Professional Advice.

The App does not provide medical advice, diagnosis, or treatment and must not be used for clinical decision-making or patient care. Nothing in the App constitutes:

  • Medical advice or a medical diagnosis;
  • A recommendation regarding patient care or therapy; or
  • A doctor-patient, health care provider-patient, or other professional relationship.

Always seek the advice of a licensed physician or other qualified health provider with any questions you may have regarding a medical condition, and never disregard professional medical advice or delay seeking it because of something you have read or seen in the App.

2.3 No Guarantees of Performance.

We do not guarantee that use of the App will result in improved test scores, exam passage, residency matching, or academic or professional success. The App is not endorsed by and is not affiliated with any exam boards or entities, including but not limited to the National Board of Medical Examiners (NBME), United States Medical Licensing Examination (USMLE), AAMC, or any residency programs.

3. License to Use the App

3.1 Limited License.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on an iOS device that you own or control and to access and use the services provided through the App for your personal, non-commercial use.

3.2 Ownership.

All rights, title, and interest in and to the App (including but not limited to software, code, visual interfaces, text, graphics, logos, audio, video, design, and all other content) are and will remain the exclusive property of Scrub Battle and its licensors, except for User-Generated Content as defined below.

3.3 Reservation of Rights.

We reserve all rights in and to the App not expressly granted to you under these Terms.

4. User-Generated Content and Public Information

4.1 User-Generated Content ("UGC").

The App allows you to upload, submit, store, and display UGC, which may include your:

  • Username
  • Profile picture
  • Any other optional content you submit in connection with your profile or participation in App features

You retain ownership of your UGC, subject to the license you grant to us below.

4.2 License to UGC.

By submitting UGC to the App, you grant Scrub Battle a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, host, store, modify, adapt, publish, display, and distribute such UGC as necessary to operate, improve, and promote the App, including but not limited to:

  • Displaying your username, profile picture, medical school, and graduation year on leaderboards and rankings;
  • Displaying your UGC in user profiles;
  • Using anonymized and aggregated data for analytics and statistics.

4.3 Public Rankings and Leaderboards.

The App includes ranking and leaderboard features. When you participate:

  • Your username, profile picture (if provided), medical school, and graduation year may be visible to other users.
  • Your performance data (e.g., points, scores, rank) may be associated with your profile and publicly displayed within the App.

By using the App, you acknowledge and consent to these public displays.

4.4 UGC Standards.

You agree that your UGC will not:

  • Be unlawful, defamatory, libelous, harassing, abusive, threatening, hateful, discriminatory, obscene, or otherwise objectionable;
  • Infringe or violate any copyright, trademark, privacy, publicity, or other rights of any person;
  • Include any sensitive personal information about others without their explicit consent;
  • Include exam questions or content copied from protected exam materials (e.g., NBME or USMLE questions);
  • Impersonate any person or misrepresent your affiliation with any person or organization.

4.5 Moderation and Removal of Content.

We reserve the right (but are not obligated) to:

  • Review, screen, filter, or monitor UGC;
  • Remove or disable access to any UGC at any time and for any reason or no reason, including if it violates these Terms;
  • Suspend or terminate accounts associated with UGC that violates these Terms.

You may report objectionable or abusive content through the reporting mechanisms in the App or by email at info@scrubbattle.com.

5. Prohibited Conduct

You agree not to:

  • Use the App for any illegal or unauthorized purpose;
  • Attempt to manipulate scores, rankings, or leaderboards by creating multiple accounts, using automated tools, or any other fraudulent means;
  • Harass, threaten, or abuse other users;
  • Attempt to gain unauthorized access to the App, its servers, or related systems (including by hacking, password mining, or other means);
  • Interfere with or disrupt the operation of the App or the servers or networks used to make the App available;
  • Use any robot, spider, scraper, or other automated means to access the App for any purpose without our express written permission;
  • Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except as expressly permitted by applicable law;
  • Circumvent or attempt to circumvent any security or authentication measures of the App;
  • Use the App to upload or transmit viruses, malware, or other harmful code.

Violation of this Section may result in suspension or termination of your account and may also expose you to civil and/or criminal liability.

6. Subscriptions, In-App Purchases, and Billing

6.1 Subscription Access.

Certain features of the App may require a paid subscription or one-time in-app purchases (collectively, "Paid Services"). Paid Services may include:

  • Monthly or yearly subscription plans;
  • Other premium features, content, or functionality.

6.2 Apple In-App Purchases.

All Paid Services within the iOS App are processed through Apple's in-app purchase system:

  • We do not collect or store your full payment information (such as credit card numbers);
  • Your purchases and subscriptions are subject to Apple's own terms and conditions and privacy policy.

6.3 Auto-Renewal.

Unless you cancel your subscription at least 24 hours before the end of the current billing period, your subscription will automatically renew for an additional period at the then-applicable price.

6.4 Managing and Canceling Subscriptions.

You can manage or cancel your subscription at any time through your Apple ID account settings on your device. Deleting the App or your in-App account does not automatically cancel your subscription with Apple.

6.5 Trials and Promotional Offers.

We may offer free trials or promotional discounts. If you do not cancel before the end of the trial or promotional period, your subscription may automatically convert to a paid subscription at the standard rate.

6.6 Pricing Changes.

We may change subscription prices or introduce new fees from time to time. Where required by applicable law, we will notify you in advance. If you do not agree to the price change, you may cancel the subscription before the change takes effect.

6.7 Refunds.

All billing, charges, and refunds are handled by Apple, not by Scrub Battle. Any requests for refunds must be made directly to Apple in accordance with Apple's policies.

7. Third-Party Services and Supabase

7.1 Supabase Backend.

We use Supabase and possibly other third-party services to store and process data, authenticate users, and provide backend functionality. These third parties may store and process your personal data on our behalf.

7.2 No Responsibility for Third-Party Terms.

Your use of third-party services integrated into the App (including Apple's services) may be subject to additional terms and conditions and privacy policies, which we do not control. We are not responsible for the content, policies, or practices of third-party services.

8. Privacy and Data Protection

Your use of the App is subject to our Privacy Policy, which describes how we collect, use, share, and protect your personal information, including:

  • Email address;
  • Hashed password;
  • Medical school and graduation year;
  • Username;
  • Profile picture;
  • Performance and usage data.

By using the App, you acknowledge that you have read our Privacy Policy and consent to our data practices as described there. The Privacy Policy is incorporated by reference into these Terms.

9. International Use and Data Transfers

9.1 Global Availability.

The App may be accessed globally. However, we do not represent that the App is appropriate or available in all jurisdictions. Accessing the App from locations where its content or use is illegal is prohibited.

9.2 Data Transfers.

If you access the App from outside the United States, you understand and consent that your personal data may be transferred to, stored, and processed in the United States and other countries, which may have different data protection laws from your country of residence.

9.3 Additional Rights.

Depending on your location (for example, if you are in the European Union, United Kingdom, or other jurisdictions with specific data rights), you may have additional rights regarding your personal data, as described in our Privacy Policy. 10. Account Suspension, Termination, and Deletion

10.1 Our Right to Suspend or Terminate.

We may, at our sole discretion and without prior notice, suspend or terminate your access to the App (including deletion or deactivation of your account) if:

  • You violate these Terms or any applicable law;
  • We are required to do so by law or a court order;
  • We discontinue or materially modify the App.

10.2 Your Right to Delete Your Account.

You may request deletion of your account and associated personal data through the in-App account deletion feature (where available) or by contacting us at info@scrubbattle.com. After verifying your request, we will delete or anonymize your personal data, except for data that we are legally required or legitimately allowed to retain (for example, transaction records or security logs).

10.3 Effect of Termination.

Upon termination or deletion of your account:

  • Your right to access and use the App immediately ceases;
  • We may retain certain anonymized or aggregated data (which does not identify you) for analytics, product improvement, or other legitimate business purposes.

11. Disclaimers of Warranties

11.1 "As Is" and "As Available."

The App, including all content, features, and services, is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.

11.2 No Warranties.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

  • Warranties of merchantability;
  • Fitness for a particular purpose;
  • Non-infringement;
  • Accuracy, reliability, or completeness of content;
  • Availability, security, or error-free operation of the App.

11.3 No Guarantee of Results.

We do not warrant that:

  • The App will meet your requirements or expectations;
  • The App will be available on an uninterrupted, timely, secure, or error-free basis;
  • Any errors or defects will be corrected;
  • Any particular results (such as exam scores, grades, or career outcomes) will follow from your use of the App.

12. Limitation of Liability

To the fullest extent permitted by applicable law:

12.1 Exclusion of Certain Damages.

Scrub Battle and its officers, directors, employees, members, agents, licensors, and affiliates shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses arising out of or in connection with your use of or inability to use the App.

12.2 Cap on Liability.

Our total cumulative liability to you for any and all claims arising out of or relating to the App or these Terms shall not exceed the greater of:

  • The total amount you paid to us for use of the App in the twelve (12) months preceding the event giving rise to the claim; or
  • One hundred U.S. dollars ($100).

12.3 Jurisdictional Limitations.

Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, the limitations in this Section shall apply to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Scrub Battle and its officers, directors, employees, members, agents, licensors, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your access to or use of the App;
  • Your UGC;
  • Your violation of these Terms; or
  • Your violation of any rights of another party.

14. Governing Law; Dispute Resolution

14.1 Governing Law.

These Terms and any disputes arising out of or relating to them or the App shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

14.2 Venue.

Subject to any arbitration requirements under applicable law, any legal action or proceeding arising under these Terms will be brought exclusively in the state or federal courts located in Riverside County, California, United States, and you and Scrub Battle consent to the personal jurisdiction and venue of such courts.

15. Changes to the App and to These Terms

15.1 Changes to the App.

We may modify, suspend, or discontinue all or part of the App at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.

15.2 Changes to the Terms.

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this document. For material changes, we will provide additional notice (e.g., via in-App notification or email).

Your continued use of the App after the updated Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App and may request account deletion.

16. Miscellaneous

16.1 Entire Agreement.

These Terms, together with our Privacy Policy and any other supplemental policies or agreements expressly incorporated by reference, constitute the entire agreement between you and Scrub Battle regarding your use of the App.

16.2 Severability.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

16.3 No Waiver.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.

16.5 Headings.

Section headings are for convenience only and have no legal or contractual effect.

16.6 Apple App Store.

You acknowledge that:

  • These Terms are between you and Scrub Battle, not Apple;
  • Scrub Battle, not Apple, is solely responsible for the App and its content;
  • Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App;
  • To the maximum extent permitted by applicable law, Apple will have no warranty obligation or liability with respect to the App.
